Site name and ownership

These General Conditions of Sale (“General Conditions of Sale” or, alternatively, “GTC”) govern the offer and sale of Products distributed through the website www.ricciocaprese.it (“Site”) by MAJELLO 1867 srl – P.Iva : 07548291215 – Via Generale Calà Ulloa 28, 80141 Napoli NA.

Scope of the GTC

  1. The offer and sale of the Products on the Site constitute a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of Legislative Decree September 6, 2005, No. 206 (“Consumer Code”) and Legislative Decree April 9, 2003, No. 70, containing the regulation of electronic commerce.

  2. These Terms and Conditions apply to all contracts concluded on the Site.

  3. The General Conditions of Sale may be changed at any time. Any amendments and/or new conditions will be in force from the moment they are published on the Site in the “General Conditions of Sale” section. Users are therefore encouraged to regularly access the Site and consult the most up-to-date version of the General Terms and Conditions of Sale before making any purchase.

  4. The applicable General Terms and Conditions of Sale are those in effect on the date the purchase order is sent and are available in Italian.

  5. These General Conditions of Sale do not govern the sale of products by parties other than MAJELLO 1867 srl that are present on the Site through links, banners or other hypertext links. Before carrying out commercial transactions with such parties, it is necessary to check their conditions of sale.

  6. The user is required to carefully read these General Terms and Conditions of Sale, which MAJELLO 1867 srl makes available to him in the “General Terms and Conditions of Sale” section of the Site and which he is allowed to store and reproduce, as well as all other information that MAJELLO 1867 srl provides him with on the Site, both before and during the purchase process.

Purchases on the site

  1. The purchase of Products on the Site is made upon registration, pursuant to clause 4 below, and is permitted both to users who hold the status of consumers and to users who do not hold that status. Individuals are permitted to purchase only if they are eighteen years of age or older.

  2. Pursuant to art. 3, I paragraph, lett. a) of the Consumer Code, it is recalled that the quality of consumers is held by natural persons who, in relation to the purchase of the Products act for purposes unrelated to the entrepreneurial, commercial, professional or craft activity possibly carried out.

  3. MAJELLO 1867 srl reserves the right to refuse or cancel orders that come (i) from a user with whom it has ongoing legal disputes; (ii) from a user who has previously violated these GTCV and/or the conditions and/or terms of the purchase contract with MAJELLO 1867 srl; (iii) by a user who has been involved in fraud of any kind and, in particular, in fraud relating to credit card payments; (iv) by users who have provided false, incomplete or otherwise inaccurate identification data or who have failed to promptly send MAJELLO 1867 srl the documents requested by it or who have sent it invalid documents.

Site registration

  1. Registration on the Site is free of charge. To register to the Site, the user must fill out the appropriate form, entering his or her first name, last name, address, place and date of birth, telephone number, an e-mail address and a password and click on the [Submit] button.Registration on the Site, through the opening of a personal account, allows the registered user (“Registered User”) to:

    – save and modify his/her own data;
    – access all information regarding orders and returns;
    – follow the status of the order;
    – manage his/her own personal data and update them at any time;
    – take advantage of the dedicated services that may be activated from time to time (ex: viewing one’s “wish list”, etc);
    – express consent to the processing of one’s personal data for the sending by MAJELLO 1867 srl of newsletters.

  2. Registration credentials (e-mail address and password) must be kept with extreme care and attention. They may be used only by the user and may not be given to third parties. The user agrees to keep them secret and to ensure that no third party has access to them. He also undertakes to immediately inform MAJELLO 1867 srl, by contacting it by e-mail at info@ricciocaprese.it or by telephone at (+39) 081 5990422, in case he suspects or becomes aware of an improper use or undue disclosure of them.

  3. The Registered User warrants that the personal information provided during the registration procedure to the Site is complete and true and agrees to hold MAJELLO 1867 srl harmless and indemnified from any damages, compensatory obligations and/or penalties arising from and/or in any way related to the violation by the user of the rules on the registration to the Site or on the storage of registration credentials.

Cancel or modify an order

To change or cancel an order you must contact us promptly and in any case no later than 12 hours after sending the order MAJELLO 1867 srl by email at info@ricciocaprese.it or by phone at (+39) 081 5990422, ALWAYS indicating the reference order number.

Order status and shipping information

At the time of shipment, the User will receive at the email address provided during the order process the tracking number by which they can track their purchases on the courier’s website or through its call-center.

Requesting copies of documents and changes to master records

To request copies of tax documents and/or changes in personal data, the User must contact MAJELLO 1867 srl via email at info@ricciocaprese.it or by phone at (+39) 081 5990422 (this service is available only from cell phones and reserved for adults.

Product Warranty

All products marketed by MAJELLO 1867 srl on its website ricciocaprese.it are covered by a legal guarantee of conformity pursuant to and for the purposes of art. 128 et seq. of Legislative Decree no. 206 of 2005 Consumer Code.

Information on invoices, transfers and transfers

  1. Payment by bank transfer in advance
    In the case of payment by bank transfer in advance, the order will be processed only after confirmation that the full amount has been credited. Payment must be made within 3 days from the date of the order. For a correct and fast management of the order the Customer in the reason for payment must indicate order number, date, first and last name of the Customer. After this deadline the order will be automatically canceled.
    The availability of the chosen product will be evaluated at the time of ‘credit.

  2. Payment by credit card
     Where the User chooses to pay by credit card the bank of reference will authorize the charge of the amount of the purchase made. In case of cancellation will be requested by MAJELLO 1867 srll cancellation of the transaction and the reversal of the amount committed.

    Release times depend exclusively on the banking system. Once the cancellation of the transaction has been carried out MAJELLO 1867 srl cannot in any case be held responsible for delays and/or damages caused by the banking system.

    MAJELLO 1867 srl reserves the right to ask the User for additional information or sending copies of documents proving the ownership of the card used. In case of refusal MAJELLO 1867 srl reserves the right not to accept the conclusion of the contract. At no time during the purchase procedure by credit card MAJELLO 1867 srl is able to know personal information relating to the holder of the same since the information is transmitted directly to the site of the banking institution handling the transaction, a protected site.

  3. Pay Pal Payment
    By selecting the PayPal payment type, the User will be redirected to a page on the PayPal site and payment will be made in the manner specified therein.

Information provided on the PayPal site will not be shared with MAJELLO 1867 srlbut will be handled directly by it.

In case of cancellation of the order or non-acceptance by MAJELLO 1867 srl the amount will be refunded to the PayPal account. MAJELLO 1867 srl will not be in any way responsible for delays and/or damages caused at this stage.

Shipping and costs

The cost of shipping is the responsibility of the User and will be calculated automatically by the system based on the weight of the items ordered.

Order fulfillment and shipping times

Orders placed on the Ricciocaprese shop are processed based on stock availability and production time of the items purchased. For this reason, fulfillment times may vary from a minimum of 48 hours to a maximum of 10 business days.

Shipping

Ricciocaprese uses two logistics partnerships to ensure reliable delivery service, both domestically and abroad:

  • For domestic shipments, we cooperate with the Italian courier BRT, our official partner for deliveries throughout Italy.
  • For international shipments, we have partnered with DHL, a leading global logistics company, to ensure fast and traceable deliveries worldwide.

Deliveries are made Monday through Friday.

If there are any changes in delivery times from what is stated on the website, our customer service department will contact you promptly, providing timely updates.

For shipments destined for remote areas or smaller islands, delivery times may be delayed by about 48 hours from the standard time frame.

Tips for fast and smooth delivery

In order to receive your products conveniently and quickly, and to avoid possible delays caused by stock, we recommend that you give an address where someone is present during the day (e.g., place of work), or report the address of a trusted person available to pick up the package.

In the event of a stock, the Ricciocaprese team will contact you to provide new instructions to the courier and resolve the situation as quickly as possible.

Shipping Costs in Italy

Ricciocaprese guarantees free shipping on the entire catalog for orders placed for Italy.

Shipping Costs Outside Italy

For deliveries outside the national territory, the cost will depend on the destination of the goods and the type of product. For each case the shipping cost will be displayed automatically before the order confirmation.

Delivery Time

Delivery time for goods varies depending on the in-stock availability of the product purchased (e.g., whether the product is available from the manufacturer) and the delivery method provided for it.

In any case, the delivery date is merely indicative and is in no way binding for MAJELLO 1867 srl.

MAJELLO 1867 Ltd. makes use of contracted couriers/carriers that offer the best value for money for the destination concerned: this allows us to offer Customers advantageous prices and quality in service.

Under no circumstances will it be possible to make deliveries by appointment and/or at set times and/or days.

In the event of non-delivery of the goods due to incorrect address provided by the User or due to completion of storage in the warehouses of the courier / carrier and / or otherwise for any cause attributable to the behavior of the User, a new shipment will be possible ONLY upon advance payment of the same in the manner specified by MAJELLO 1867 srl.

Delivery of goods

Upon delivery of the goods, the User is required to check:

– that the number of packages delivered correspond to what is indicated in the transport document;
– that the packaging is intact and not altered even in the closing tapes.

In case of tampering and / or breakage, the User must immediately dispute the shipment and / or delivery using the document received from the courier or other operator and affixing the words “RESERVE TO CHECK GOODS FOR …..”(indicate the reason).

The User shall thereafter report any damage within 3 days of receipt of the goods in the manner prescribed by the shipping operator.

Right of withdrawal

The right of withdrawal is governed by the current regulations set forth in Articles 52 et seq. Consumer Code as amended by LEGISLATIVE DECREE February 21, 2014, no. 21.

A User who qualifies as a Consumer under Section 3.2 has the right to terminate the contract for any reason and without penalty within 14 business days and without incurring any costs other than those stipulated in Article 56, Paragraph 2, and Article 57 of the said Decree.

Nota Bene: The right of withdrawal ex art. 52 and following of the Consumer Code is RESERVED EXCLUSIVELY to the Consumer defined by the Consumer Code in art.3 as the natural person acting for purposes unrelated to the entrepreneurial, commercial, handicraft or professional activity possibly carried out (2).

Therefore, those who purchase with VAT number and therefore in the capacity of a company and/or professionals cannot exercise the right of withdrawal.

Modalities of withdrawal

The right of withdrawal must be exercised in the following manner:

  • The purchased product must be intact and returned in the original packaging still sealed, complete in all its parts ( including packaging and any documentation and accessory equipment: manuals, sticks, etc.).
  • To exercise this right, the User must send MAJELLO 1867 srl a notice by email to info@ricciocaprese.it within 10 working days from the date of delivery of the goods.
  • Once the above communication has been made, and received acknowledgement of receipt from MAJELLO 1867 srl , the User shall send the Product, at its own expense – after regular and appropriate packaging in its original packaging – by express courier, together with a copy of the receipt, to the following address: MAJELLO 1867 srl – Via Generale Calà Ulloa 28, 80141 Napoli NA.

Shipment until receipt in our warehouse is the full responsibility of the User.

MAJELLO 1867 srl is not liable in any way for damage and/or theft/loss of products returned by uninsured shipments.

Returns and Refunds

The goods must be returned to ‘MAJELLO 1867 srl within the terms set forth in paragraph 14 together with the authorization form received.

Without prejudice to any repair costs for damages assessed to the original packaging, MAJELLO 1867 srl will refund the User the full amount within 14 days of return of the goods by transferring the amount charged to the Credit Card or by Bank Transfer.

In the latter case, it will be the User’s responsibility to promptly provide the bank details on which to receive the refund (IBAN Code of the customer).

Forfeiture of the right of withdrawal

The User forfeits the right of withdrawal and the consequent right to a refund in the event that MAJELLO 1867 srl ascertains the existence of even one of the following conditions:

– Even partial use of the good and any consumables;
– Lack of the original outer packaging and/or inner packaging;
– Absence of product components (accessories);
– Damage to the product due to causes other than its transportation

In the above cases MAJELLO 1867 srl will return the goods to the User by charging the shipping costs.

Applicable law

  1. The purchase contract concluded on the Site is governed by Italian law.

  2. It is without prejudice to the application to Consumer Users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence, in particular in relation to the deadline for exercising the right of withdrawal, the deadline for the return of the Products, in the event of the exercise of such right, the methods and formalities for the communication thereof and the legal guarantee of conformity.

  3. Please note that in the case of a consumer user, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, the court of the place where the user resides or has elected domicile shall have jurisdiction. In the case of non-consumer user, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale is exclusively competent the court of Naples.

  4. The user who resides in a member state of the European Union other than Italy, may, in addition, have access, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, to the European procedure established for small claims, by Council Regulation (EC) No. 861/2007 of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 2,000.00. Notice to Consumers - ODR Online Dispute Resolution

In compliance with the provisions of art. 14 of EU Regulation 524/2013/EU the Consumer User is informed that, as an alternative to judicial dispute, both the consumer and MAJELLO 1867 srl may avail themselves of the alternative online dispute resolution by filing a complaint through the platform established by the European Commission. This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to and/or arising from contracts of sale of goods and services concluded online.
